FAQ
Frequently asked questions
What is an economic concentration?
It is any change of control or material influence over one or more companies, such as a merger, the acquisition of shares or assets, or the creation of a joint venture. It is subject to prior review by the Egyptian Competition Authority (ECA) when it exceeds the legal thresholds.
When is prior approval from the Competition Authority required?
Prior notification and approval are required when the transaction reaches the turnover or deal-value thresholds set out in Competition Law No. 3 of 2005, as amended, and its executive regulations. Closing before approval exposes the parties to penalties, so we recommend assessing the deal early.
Which practices does competition law prohibit?
The most important are agreements between competitors to fix prices, divide markets or rig bids, and abuse of a dominant position. We offer compliance programmes and training to help companies avoid these risks.
Do you represent companies in investigations and lawsuits?
Yes. We represent companies before the Competition Authority in notifications, investigations and information requests, and before the economic courts in competition-related cases.
